These Terms of Use ("Terms") constitute a legally binding agreement between you and DIRE MONEY TRANSMITTER LLC ("Company," "we," "us," "our"), governing your access to and use of the Morvanta platform, including the cryptocurrency exchange interface, integrated software wallet, and all associated services accessible at morvanta.org.
Read these Terms carefully before using the platform. By creating an account or accessing any part of the Morvanta platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.
The Morvanta platform is available exclusively to individuals who meet all of the following criteria:
You must be a legal resident of the United States. You must be at least 18 years of age. You must have the legal capacity to enter into a binding contract under applicable law. You must not be prohibited from using financial services or digital asset platforms under any applicable federal or state law or regulation.
Additionally, you must successfully complete Morvanta's identity verification process, which includes submission of a valid government-issued photo identification document and any additional information required under our Know Your Customer (KYC) program. No trading or wallet functionality is accessible until identity verification is complete and approved.
We reserve the right to decline any application for any reason consistent with applicable law and our compliance obligations. Services may not be available in all US states due to state-level money transmission licensing requirements.
Morvanta provides the following services to verified account holders: a regulated cryptocurrency exchange interface enabling the purchase and sale of Bitcoin (BTC) and Ethereum (ETH); an integrated software wallet for managing digital asset holdings; real-time market data for supported assets; and transaction history and account management tools.
Morvanta does not provide investment advice, financial planning services, tax guidance, or any form of personalized recommendation. Information displayed on the platform, including market data, pricing, and historical transaction information, is provided for informational purposes only and does not constitute investment advice.
Cryptocurrency markets are volatile. Past performance of any digital asset is not indicative of future results. You are solely responsible for all decisions made in connection with your account.
Morvanta charges fees for certain transactions and services. The applicable fee for any transaction will be disclosed to you before you confirm that transaction. By confirming a transaction, you authorize Morvanta to deduct the disclosed fee from your account.
Fee structures may be updated from time to time. Changes to fees will be communicated to account holders in advance. Continued use of the platform following a fee change constitutes acceptance of the updated fee structure.
You are responsible for any taxes applicable to your digital asset transactions under federal and state law. Morvanta does not provide tax advice and does not withhold taxes on your behalf unless required by law.
You agree that you will not use the Morvanta platform for any of the following purposes:
Any activity that violates applicable federal or state law, including but not limited to the Bank Secrecy Act, anti-money laundering statutes, sanctions regulations administered by the Office of Foreign Assets Control (OFAC), or any other financial crimes law.
Providing false, misleading, or incomplete information during identity verification or at any other point during your use of the platform.
Attempting to circumvent, disable, or interfere with any security, compliance, or monitoring feature of the platform.
Using the platform on behalf of another person without proper legal authorization, or for the purpose of structuring transactions to evade reporting requirements.
Engaging in any activity that would constitute money laundering, fraud, market manipulation, or any other financial crime under applicable law.
Violation of these prohibitions may result in immediate account suspension, termination, and referral to law enforcement or regulatory authorities as required by law.
Cryptocurrency involves substantial risk of loss. The value of digital assets can fluctuate significantly over short periods. You may lose some or all of the value of any digital asset you hold or transact in through the Morvanta platform.
Digital assets held through the Morvanta software wallet are NOT deposits and are NOT insured by the Federal Deposit Insurance Corporation (FDIC). They are NOT bank guaranteed. Digital asset markets operate continuously and are subject to volatility, liquidity risk, regulatory risk, and technological risk.
Past performance of any digital asset is not indicative of future results. Information provided on the platform does not constitute investment advice. You should consider your financial situation and risk tolerance carefully before transacting in digital assets.
We reserve the right to suspend or terminate your account at any time, with or without prior notice, for any of the following reasons: violation of these Terms; failure to maintain accurate identity information; activity that triggers our AML monitoring program; legal or regulatory requirements; or any other reason that we determine, in our sole discretion, warrants account action.
Upon termination, your access to the platform and software wallet will be disabled. Any pending transactions at the time of termination will be handled in accordance with applicable law and our internal procedures. You remain responsible for any obligations incurred prior to termination.
To the maximum extent permitted by applicable law, DIRE MONEY TRANSMITTER LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of digital asset value arising from your use of the Morvanta platform.
We are not responsible for losses resulting from cryptocurrency market volatility, network failures, third-party service disruptions, or events outside our reasonable control. Our total liability to you for any claim arising from your use of the platform is limited to the fees paid by you to Morvanta in the three months preceding the claim.
Nothing in these Terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be excluded by law.
These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or your use of the Morvanta platform that cannot be resolved informally shall be submitted to binding arbitration administered by a recognized arbitration body under its applicable rules. The arbitration shall take place in Seattle, Washington. You agree to waive any right to a jury trial or to participate in a class action.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction where necessary to prevent irreparable harm.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will provide additional notice to verified account holders by email or through a platform notification. Continued use of the platform after the effective date of any modification constitutes your acceptance of the updated Terms.
